The law requires us to check whether anyone supervises, directs or controls you (or has the right to do so) in the provision of your services on each assignment that you work on.  Therefore, before we can pay you correctly we need you to complete and return the enclosed documents.  We will also ask the end hirer and the agency to answer questionnaires to provide further evidence.

    Bar 2064 Limited Self-Employed Status Questionnaire

    Mutuality If you are self-employed there will be a lack of mutuality between you and Bar 2064 Limited. If you are self-employed you cannot assume that the work will continue once the assignment you are engaged on comes to an end. You will be responsible to look for other work and to approach other companies to look for work.

    Control If you are self-employed you will be asked to do a job but it will be up to you how you complete it. You will only be expected to carry out the work detailed in your contract and relevant Works Order unless there is an agreed variation.
    If you are self-employed means you are not entitled to receive certain rights and benefits that you would receive if you were an employee. You understand that you are not entitled to receive the following benefits from Bar 2064 Limited: - Holiday Pay - Employer’s Sick Pay * - Employer’s Maternity/Paternity Pay * - Pension Rights * Any claim to statutory sick, maternity or paternity pay etc. would need to be made direct to the Department for Work and Pensions.

    This is only required if you are self-employed AND working in construction
    If you are self-employed you accept a degree of financial risk. For instance, the amount you receive is dependent on what you charge and if any work undertaken is sub-standard or defective you will be liable to correct the work at your own cost.
    If you are self-employed you can supply a substitute to perform the services if you are unwilling or unable to, for example if you are on another job or you are unwell (subject to the terms of your agreement with us).
